TERMS AND CONDITIONS

 

1 General

1.1 Pelican’s Nest Holiday Home, situated at 43 Pelikaan Street, St Lucia KZN, South Africa (“the Guesthouse”)
is owned and operated by Bianca and Karel Viviers, owners of Pelican’s Nest Holiday Home, Reg. No. 2012/032595/07, a company registered in the Republic of South Africa.

1.2 All reference to “Guests” includes actual guests booked into the Guesthouse, accompanying visitors and family members, as well as potential guests. The Guesthouse and the guests shall be referred to as “the Parties”.

1.3 These Terms and Conditions (“these terms and conditions”) are deemed as being accepted on receipt of payment for the booking. Some policies may vary when booking online with third party sites. Please check the relevant online policies and your confirmation emails carefully. These terms and conditions will always prevail where there is a conflict with other terms and conditions.

1.4 No smoking is permitted in the rooms, inside the house or any indoor areas, or in the pool. A designated area at the Patio is set up for smoking. The smoking of cannabis or the use of any drugs is strictly prohibited.

1.5 We do not pay third parties for any other services on your behalf. If monies are deposited into our account incorrectly, we do not refund until cleared with our bank and will only refund directly into the original payer’s account, less any banking and transaction fees.

1.6 No Parties, loud noise or loud music will be aloud at the Guesthouse. The Guesthouse reserves the right to remove from its premises any Guest or visitor who does not comply with these terms and conditions, who causes a nuisance or disturbs the peace, who is deemed to be a risk to the health and safety of others or to the Guesthouse’s reputation, or whose behaviour is unacceptable in the opinion of the representative of the Guesthouse on duty at the relevant time.

1.7 All Guests are required to register in writing and sign the registration paper on arrival.

1.8 No Persons other than Guests duly registered with the Guesthouse are permitted to enter the premises, unless the Guesthouse has given its prior written approval.

2 Cancellation Policy

2.1 Due to the nature and exclusiveness of the premises, it may not be possible to obtain an alternative booking in the event of cancellation and therefore the following cancellation policy applies:

2.1.1 Cancellations within 48 hours of booking are cancelled free of charge.
All cancellations thereafter will be charged 3% of the total deposit already paid for refund / bank charges & admin fees.
If cancelled up to:
• 31 days before arrival: Free Cancellation.
• 30 days before arrival: 20% of total booking will be due.
• 20 days before arrival: 50% of total booking will be due.
• 10 days before arrival: 75% of total booking will be due.
• 7 days before arrival / no-show: 100% of total booking will be due.

2.1.2 In the event of any early departures a cancellation fee of 100% in respect of such unused period of the booking will apply.

2.2 Cancellation fees apply irrespective whether the required deposit has been paid.

2.3 The Guesthouse reserves the right to accept, with condition or refuse totally, requests to change booking dates by Guests if the dates are available.

2.4 Due to security reasons, refunds may only be processed where the Guesthouse has received confirmation from its bankers that the payments has been credited and is not subject to any recall.

2.5 Rooms may be re-let if no notification from the Guest is received of any unexpected delays by 22h00h on the intended arrival date.

 

3 Payment Policy

3.1 Unless otherwise agreed, rates are quoted in South African Rand (ZAR). Bank charges incurred by the Guesthouse when receiving payments are for the account of the Guest.

3.2 The rates are displayed on the website unless agreed otherwise via email correspondence and are subject to change without notice and availability of the house.

3.3 Bookings are taken in advance but reservations are only confirmed on receipt of payment.

3.4 Generally 50% deposits will be requested for bookings. Deposits to be paid within 24 hours to secure the booking. Full payment will be due if booked within 7 days of arrival.

3.5 Only payments which have cleared and are reflecting as actual available balances in the Guesthouse’s account shall be considered as having been received.

3.6 Please e-mail proof of payment through to info@pelicansneststlucia.co.za or whatsapp to +27810453381. Use your name and date of arrival as reference. Please note that the Guesthouse will never change its banking details by means of simply sending out any email to this effect.

3.7 A booking will automatically be deemed cancelled if payment has not been received by the due date.

3.8 Proof of payment may be requested on arrival and where payment was made by credit card, the actual credit card must be presented.

3.9 No persons other than those quoted for are permitted to share the accommodation. If extra guests join that were not booked for, they will pay extra per person per day.

3.10 The Guesthouse accepts MasterCard, Visa credit cards and electronic fund transfers.

3.11 Booking the guesthouse authorises the Guesthouse to make the booking charges to the card without any additional consent being required.

4 Arrival and Departure

4.1 Check in is from 14h00 to 22h00. If the guest arrives in St Lucia earlier, you may contact the owner to hear if you may check in earlier. If the house is ready, you may check in.

4.2 The booking will be deemed cancelled if the guest has not checked in by 22h00, unless prior notification has been given of the late arrival.

4.3 Check out is by 10h00 latest on the day of departure.

5 Child Policy

5.1 Children of all ages are vwelcome.

5.2 Children under the age of 14 years, shall always be under responsible adult supervision – indoors and outdoors at all times.

5.3 It is the duty of the guests to monitor their children, the Guesthouse accepts no liability for any injury or loss that may occasion to or on account of any conduct of the children also vis-à-vis any other guests.

6 Guesthouse Rules

6.1 Pets are welcome by prior arrangement only. Pets are not allowed on the beds or couches. Guests will be held responsible for any damage caused by their pets, and payment for such damages must be made prior to departure.

6.2 Guests are not permitted to remove towels, bedding, pillows, utensils, furniture, equipment and any other fixtures that belong to the Guesthouse from their respective rooms or other areas of the Guesthouse.

6.3 The guesthouse is situated in a residential area; therefore, guests are kindly requested to keep noise levels to a minimum and avoid loud disturbances. The guesthouse management reserves the right to monitor and control noise levels, particularly between 22h00 and 8h00.

6.4 The Guesthouse reserves the right to charge a guest for the replacement, deep cleaning or repair of any item(s) belonging to the Guesthouse or any other guest, damaged by the former guest or a person under such guest’s care or responsibility, either wilfully or because reasonable precautions have not been taken.

6.5 The Guesthouse reserves its right to charge for the replacement of items that are found to be missing following departure.

6.6 Should guests want to use the premises for commercial photo shoots or any other commercial endeavour, prior written consent is required from the Guesthouse.

7 Disclaimer Notice / Indemnity

7.1 All Guests (including their family members, visitors or invitees) entering onto or residing at the premises of the Guesthouse do so entirely at their own risk. Right of Admission is reserved.

7.2 It is an express condition of entering onto, residing or interacting with the Guesthouse, its staff, contractors, owners and agents, that all Guests/visitors will be bound by this indemnity.

7.3 The person booking the Guesthouse agrees to inform all Guests/visitors in his/her party of the contents hereof and all such persons will be considered bound by the provisions contained herein.

7.4 All Guests and visitors agree to fully indemnify the Guesthouse, its owners, employees, agents, contractors and hold them blameless against any acts, occurrences or omissions, directly or indirectly, negligent or otherwise, at the Guesthouse or in the course of dealing with the Guesthouse, including but not limited to theft, damage, injury, loss or death, to the person and/or to their property, including any motor vehicle parked at the Guesthouse, any interruption in any services, including electricity and WI-FI, any injury sustained due to non-conformity with these terms and conditions or the House Rules, misuse of the facilities, intoxication and disorderly conduct, and where a claim justifiably lies against the Guesthouse, same shall be limited by the applicable insurance cover of the Guesthouse.

7.5 The Guests and visitors, in addition to the aforesaid, hereby indemnify the owners against any claims which may arise against them or the Guesthouse, from whatever nature, whether arising from the owners’ default, negligence or otherwise.

7.6 Whilst the Guesthouse endeavours to keep its premises secure with various top level security services, its owners, employees, agents, and contractors will not be held liable for any loss, theft or damage to any personal belongings, including but not limited to, cash, jewellery, electronic equipment, camping equipment, sporting and recreational equipment or motor vehicles, however caused, during the Guest’s stay.

7.7 The Guesthouse does not express or imply any warranties or guarantees with respect to the Guesthouse’s services and facilities other than what is contained in these terms and conditions.

7.8 The Guests/visitors are not relying on any representation, guarantee or statement other than as set forth in these terms and conditions or by another written agreement between the parties. By reading this General Indemnity and Disclaimers, the Guest/visitor acknowledges that he/she understands and agrees to these terms and conditions and any applicable rules which the Guesthouse may establish from time to time, for example regarding the use of its WI-FI, water and electricity conservation regulations and matter of guest privacy (“the House Rules”).

7.9 Any incidents or injury, damage, theft or other loss shall be immediately reported to the representative of the Guesthouse on duty and the person reporting the incident shall complete such forms as the Guesthouse may require for this purpose.

7.10 The Guesthouse has a swimming pool with no life guards on duty. Entering into the pool will be at the sole risk of the Guests/visitors. Children must be under responsible adult supervision at all times. The Guesthouse has an outdoor braai/barbeque area or fire place. All Guests/visitors make use of these facilities at their own risk and need to obey all applicable fire regulations and by-laws. Any damages resulting from unattended fires or hot coals will be at the expense of the Guest/visitor.
